HC upholds conviction order of Sessions Court

The High Court of Manipur has upheld the conviction order passed by Sessions Judge Bishnupur with regard to Trial Case No.8 of 2018 and further dismissed Criminal Appeal No.7 of 2017 .
Appellant Elangbam Gopal (57) of Toubul Awang Leikai had filed the Criminal Appeal No.6 of 2017, mentioning the state of Manipur as respondent, which was heard in the court of chief justice Sanjay Kumar and justice MV Muralidharan.
The court reserved the judgment on November 21, 2022 and later announced the judgment on December 21.Elangbam Gopal is mentioned as an accused (no.1) in an FIR registered by Bishnupur PS and was convicted on May 2, 2017 by the District and Sessions Judge under Section 302 of IPC in the murder case of one Mayanglambam Premananda on November 23, 2000.He was sentenced to life imprisonment.
According to the prosecution, one Mayanglambam Dhonjaoba made a report to Bishnupur PS around 8am on November 24, 2000, informing that his elder brother Premananda had been ambushed and stabbed by Elangbam Gopal, his father and other accomplices at Toubul Micro Bazar on November 23 around 7.30 pm.
His brother succumbed to injuries at the hospital.
In connection with the case, the police conducted an investigation and filed the charge sheets against Gopal and his father Ibochouba on November 3, 2012.During the course of the trial, Ibochouba passed away on March 28, 2014 and CJM Bishnupur closed the criminal proceedings against the deceased.
District and Sessions Judge, Bishnupur then framed charges against Gopal and declared him guilty of all charges under Section 302 of IPC.
It further sentenced the accused to life imprisonment and directed the accused to pay a fine of Rs 2000 .
After hearing of the case, Chief Justice Sanjay Kumar and Justice MV Muralidharan upheld the conviction order of the Sessions Judge while further dismissing Criminal Appeal No.7 of 2017 and Criminal Appeal No.6 of 2017, which was filed with request for granting interim relief.
