CJM Imphal West denies bail

Chief Judicial Magistrate Imphal West has denied bail to Haobam Ibomcha, who was accused of assaulting a girl student recently.
The Court of the CJM Imphal West remanded him to judicial custody till October 24 and denied him bail after hearing his application (for bail) on October 10 .
It may be noted that Haobam Ibomcha was accused of sexually assaulting a girl student on October 4 somewhere in Imphal.
The girl was on her way to attend a tuition in the early morning of October 4 when the accused allegedly assaulted her sexually and fled.
The accused Haobam Ibomcha (43) of Lalambung Makhong Takhellambam Leikai was produced before the Court after the completion of the police custody period by the Investigating Officer of the case, Rattana Ngaseppam, Additional Superintendent of Police, Investigative Unit Crime Against Women, Imphal West.
While the defense Counsel of the accused filed a remand objection along with the prayer for bail, the Investigating Officer submitted to the Court that the accused has, during interrogation, admitted to the charges levelled against him.
As admitted during interrogation, on October 4 morning at around 4.30, H Ibomcha went for morning exercise on his two wheeler vehicle Suzuki Access at Kanglapat footpath.
Since it was early to return home, he then loitered around the area of the incident and saw an unknown girl (victim) coming towards him.
As he had the urge to touch the girl, he followed her on his scooter.
He then stretched out his left arm, used force and grabbed, and pressed the victim's private part and fled on his scooter.
On the other hand, the defense Counsel objected that Ibomcha had committed the crime and claimed that the action of the accused was not intentional.
He had merely pushed (the victim) to avoid collision due to the bad condition of the road and there was no use or exhibition of force by the accused person, said the Counsel praying to release Ibomcha on bail.
The Court after hearing the submission of both parties, and on perusal of the case record and CCTV footage of the incident, remanded the accused to judicial custody till October 24 for smooth investigation of the case.
