The Court of Session Judge Imphal West in charge has directed Lamphel police station to submit the details of the FIR registered against Congress youth wing president Ningthoujam Popilal returnable before February 16 .
Ningthoujam Popilal (28), s/o Ramesh of Phayeng Mayai Leikai filed an anticipatory bail application under Section 148 CrPC in connection with the FIR lodged against him at Lamphel police station.
The petitioner was accused of attempting to murder the members of Bharatiya Janata Yuva Morcha with deadly weapons on February 9 at around 9 pm near Lamphel police station in a complaint submitted to police by Manoharmayum Barish Sharma, president BJYM, State unit.
The petitioner counsel, however, claimed that Popilal is innocent and has been implicated falsely.
The petitioner is a respectable person and there is no chance of him absconding or tampering with the evidence, it continued.
The PP of the State, on the other hand, stated that the petitioner didn't disclose the allegation levelled against him and prayed for rejecting his prayer.
The Court on perusal of the anticipatory bail application observed that at the time of filing an anticipatory bail application, the applicant needs to disclose the allegations levelled against him.
In the present case, there is no mention of any allegation levelled against the petitioner, the Court said and added that the summon issued to the petitioner by the Officer in Charge of Lamphel police station didn't mention any specific Section under which the petitioner was summoned.
The Court further observed that it would be proper to consider the prayer of the petitioner for grant of anticipatory bail or interim relief only after receiving a report from Lamphel police station.
Hence, the Court directed the Officer in Charge of Lamphel police station to submit a detailed report of the FIR returnable on or before February 16 .
Mention may be made that the FIR number 32(2) 2023 Lamphel Police station was registered based on the complaint lodged by Manoharmayum Barish Sharma, president BJYM against the petitioner Ningthoujam Popilal, president of Manipur Pradesh Youth Congress and three other unknown persons under Section 307/ 326/34 IPC and 25(1-b) Arms Act.
The complaint claimed that Popilal assaulted their functionaries M Suresh and Alex Ningombam at gunpoint with an intention to kill them.
