Ch Brajachand, Judge Fast Track Special Court II Manipur convicted a 24 years old man on the charge of committing aggravated penetrative sexual assault and murdering a minor cousin sister on November 9, 2014 in Thoubal district, today.
The convict who is presently lodged in judicial custody at Manipur Central Jail since the beginning of the case was produced before the Court for the judgment order which was kept reserved at the final hearing held on June 27 after hearing the submission of A Ashok Sharma, Special PP and defence counsel of the convict.
The case was on against the convict after the father of the victim lodged a complaint before the Thoubal police station on November 9, 2014 who claimed that his minor daughter went to the house of the convict to take her mobile phone.
As the victim did not return home, his youngest daughter went to the house of the convict and found her sister/ victim lying naked in an unconscious state on the bed of the father of the convict, as per the complainant.
Later, the victim was taken to Thoubal district hospital but the doctor there declared her dead hence a case was registered for investigation.
The convict was arrested on November 10, 2014 .
The IO of the case Th Rosie, then Women Sub Inspector of Thoubal, after thorough investigation, submitted the charges sheet before the CJM Thoubal against the convict for trial on June 5, 2015.Since the case was exclusively triable by Session Court, the case was committed to the Session Judge Thoubal.
The case was again transferred from Session Judge Thoubal to the Fast Track Special Court II Manipur by an order of the High Court of Manipur.
To prove the charges levelled against the convict 33 prosecution witnesses were examined and cross examined by the Court.
In defence of the convict, one witness was also produced before the Court during the trial.
The Court observed that the circumstantial evidence clearly pointed that the prosecution has proven the charges levelled against the convict beyond doubt.
Hence, the Court convicted the convict under Section 6 of POCSO Act for committing aggravated penetrative sexual assault and under Section 302 for 'murdering' the minor.
The Court fixed July 8 for sentence hearing to announce the quantum of punishment.
