Criminal Revision Case disposed without any opinions

The court of District and Sessions Judge, Imphal West on Monday disposed the Criminal Revision Case no 2 of 2022 filed by Ministry of Defence in connection with fake encounter cases.
The hearing of the Criminal Revision Case, which mentions the Central Bureau of Investigation and Extra Judicial Execution Victims Families Association, Manipur as respondents, was held on Monday.
After listening to the submissions of the respective counsels of the petitioners and the respondents, the court observed that the Magistrate is empowered to provide references u/s 395 (1) of CrPC.
Under sub-clause (2), the Session and Metropolitan Magistrate can give reference in areas not covered by sub clause (1).With reference to the impugned order of February 22, 2021, the FR remained pending in the Court of CJM Imphal West.
After referring with the High Court, CJM Imphal West disposed the FR.Truthfully, the FR cases of all referred cases are kept pending until a response is received from the High Court.
Nonetheless, the matter should not be affected based on this technicality.
Considering the above, the Court of CJM Imphal West declared that the 10 questions referred in the Criminal Revision Case no 2 of 2022 are disposed without any opinions/suggestions.
