10-yr RI for man convicted of raping minor

Fast Track Special Court Manipur-2 on Tuesday sentenced one Nemengcha alias Memengcha alias Thangtinsem Khongsai alias Sanathoi alias Thoi alias Boisem, who was convicted in an abduction and rape case of a 17-year-old girl, to 10 years' rigorous imprisonment.
It may be mentioned that as per the report submitted by the prosecution during hearing of the case conducted on April 19, father of the victim filed a complaint at Women PS Thoubal on August 27, 2018, in which the complainant reported abduction of his 17-year-old daughter from Babu Bazar Thongkhong by an unidentified person on August 25, 2018 at around 8 pm.
Her daughter was raped and abandoned in Uripok area the next day around 8 pm.
Based on the complaint, Women PS Thoubal registered a FIR and began investigation.
During the course of the investigation, the accused person was arrested from Thoubal parking near Johnstone Higher Secondary School on August 30, 2018.Police got remand of the accused person till September 5 from the special court (POCSO) .
The IO filed chargesheet on April 30, 2019 and took cognizance of the crime under IPC Section 366-A and POCSO Act Section 4.After hearing submission from both sides, the court observed that the prosecution has produced evidence to prove that the accused person committed the crime.
The court declared him guilty under IPC Section 366-A and POCSO Act Section 4 in its April 19 hearing, and sentenced him to rigorous imprisonment for 10 years along with a fine of Rs 2000 during the sentence hearing on Tuesday.
In case, he fails to pay the fine, he will stay in the prison for another three months.
The duration of his stay in judicial custody during the trial and investigation of the case shall be commuted from the total sentence period.
The court further directed the state government to award a compensation of Rs 6 lakh from the government's victim compensation fund or any other fund to the victim when she becomes an adult.
It also directed District Legal Services Authority, Thoubal to assist the victim through Manipur State Legal Services Authority in receiving the compensation amount.
