Special Judge (NIA) Manipur has granted interim bail up to June 30 to Narengbam Samarjit on medical ground.
NIA filed chargesheet against Samarjit and four others on March 3 last year.
Consequently, Samarjit was arrested on March 31 the same year and was remanded to police custody till April 12 and then to judicial custody.
During his judicial remand, he complained of developing hypertension, heart ailment, diabetes and kidney stone.
During the proceedings of the case, the court sought medical report from the SP of Manipur Central Jail Sajiwa on January 25 this year and the report was submitted on January 29 .
During the hearing of his bail application, Samarjit's counsel submitted medical report of the medical officer of jail and JNIMS while stating that he would require treatment in a hospital outside the state.
In response, the special public prosecutor (NIA) submitted that the accused had filed three bail applications of which the first and second were dismissed by the court on September 22 and December 31, 2021 respectively.
Instead of filing petition to the high court against the judgment of the court, the accused filed his third bail application to the same court with the intent to delay the proceedings of the case.
After hearing submission from both sides, the court granted the interim bail on execution of PR bond of Rs 2 lakh along with surety by two government employees up to June 30 to undergo medical treatment.
The court also said that the accused should surrender himself before the court once the interim bail expires.
He was also advised not to intimidate or influence any individual in relation with the case and he cannot leave the state without the permission of the court.
The court further directed the accused to submit his treatment report on the last working day of every month starting from March.
He should report to the NIA office every Saturday before 12 pm and record his attendance.
In case of hospitalisation, a representative should continue the weekly reporting at the NIA office in his place.
He should also submit mobile numbers he would use during his bail period to the NIA office and the court.
In addition to the surety bond, he should also keep an immovable property as security to the court, the court directed.
Scheduling the next hearing for examining his medical report on March 31, the court observed that NIA can nullify the interim bail if the accused person violates the conditions of the bail.
