Court reprieve for Samarjit Narengbam

With reference to provisions laid under Section 41 and 41A of the CrPC, District and Sessions Judge, Imphal West has asked the investigating authority to give three days prior notice to Narengbam Samarjit in case he is to be arrested.
Samarjit, who declared Manipur's Independence in London, filed anticipatory bail for granting pre-arrest bail, coupled with ad-interim relief before the court.
Counsel of Samarjit submitted that he was released on interim bail on medical grounds on March 17 this year by the special judge (NIA) Manipur.
After his release, he is under constant medical treatment till date and the doctor advised him to take bed rest.
Since his release, he has not violated any directions or conditions set by the court.
On May 5, Samarjit was facing serious health issue and visited his doctor.
At that time, some police personnel identified themselves as personnel of Lamphel PS came to his home and asked him to report to the police station in connection with the FIR case.
However, Samarjit could not appear on the same day due to his health condition.
On May 6, the same police team demanded him to appear before the PS while threatening of arrest in case he does not comply, the counsel elaborated.
The counsel further informed that Samarjit is not an accused in the FIR case, for which the police personnel asked him to appear before the PS.
Considering the situation, Samarjit has apprehension that he would be arrested and detained in custody on false charges of non-bailable offences, the counsel said.
After hearing the submission, the court observed that Samarjit is not named as an accused in the referred FIR case and directed the investigating authority to comply with the provisions laid under Section 41 and 41 A of the CrPC and to give prior notice of three days to the petitioner in case the arrest of the petitioner is required.
