Disqualification of Kh Joykisan sought

The internal wranglings within the Trinamool Congress has snowballed into a bigger issue, with one Oinam Kabi of Thangmeiband Sinam Leikai submitting an application to the State Assembly Speaker, seeking the disqualification of Kh Joykisan, MLA of Thangmeiband Assembly Constituency on alleged ground of anti-party activities.
This comes close on the heels of six Trinamool MLAs, including Kh Joykishan being suspended from the primary membership of the party.
The suspension order of the six TC MLAs was issued from Kolkata.
Simultaneously general secretary of the All India Trinamool Congress Derek O'Brien had on June 2 issued an order appointing Th Shyamkumar as the president of the State unit of Trinamool Congress.
The petitioner sought the disqualification of Kh Joykisan under the 10th Schedule of the Constitution of India.
In the petition submitted to the Speaker, Oinam Kabi said that Kh Joykisan contested and won the election from Thangmeiband Assembly Constituency as a candidate of the All India Trinamool Congress.
During the filing of nomination papers for the election to the 10th Assembly in 2012, Joykisan in his affidavit had stated that he was contesting as a candidate of the All India Trinamool Congress, said the petition.
Moreover he was declared elected on March 12, 2012 as a candidate of AITC in the Gazette Notification and copies of the same were submitted to the Speaker.
Taking the argument further to seek the disqualification of Kh Joykisan, the petition said that the MLA himself had stated that he has been elected president of the Manipur Pradesh Trinamool Congress and that the AITC is a regional political party.
The petition also quoted Joykisan as having said that since the Election Commission of India has given recognition to the MPTC as a State party, it is no longer a unit of the AITC.
This violated the constitution of the AITC, said the petition and added that Joykisan should be disqualified under the provision of 2 (I) (a) of the 10th Schedule of the Constitution of India, added Oinam Kabi.
On the other hand a 12 member Trinamool Congress Committee, an adhoc body, headed by B Gojen as the president has been floated.
