Rape convict sentenced to 7-yr RI

Special Judge of POCSO Court, Ukhrul on Thursday sentenced a 67-year-old rape convict to seven years of rigorous imprisonment (RI) and imposed a fine of Rs 10,000 for raping a minor victim girl.
The convict, Jonathan Khongreiwoshi, son of (late) Kachang Khongreiwoshi of Marem Khullen village, Ukhrul district was awarded the sentence under the Protection of Children from Sexual Offence (POCSO) Act, 2012 and 506 IPC, in an order passed by Special Judge (POCSO), Ukhrul Samom Ibjen.
According to the order, the amount of fine is to be paid within two months from the date of passing the order and the same should be deposited to the Court and given to the victim through her father.
In case of default in paying the fine, the convict will undergo another imprisonment for six months.
in addition to the sentence awarded, it said.
The Court further recommended for awarding the victim a compensation of Rs 7,50,000 to be given through her father within 60 days from the date of receipt of the order.
The court awarded the sentence to the convict after taking cognisance of the submission of the special public prosecutor for the state as well as that of the advocate for the convict.
It noted that the victim suffered from mental trauma after the unfortunate incident and also took note of the fact that the convict is an aged person, almost on the verge of end point of life expectancy given by United Nations, which is 70.19 years.
Notice is further taken of the fact that the convict is continually receiving medication and medical treatment on account of his suffering from chest pain, giddiness and vertigo.
The convict had served 233 days of judicial custody before he was released on bail on April 13, 2022 .
However, the period undergone by the convict in the judicial custody during the period of investigation as well as during the trial, if any, will be commuted from the sentence awarded, the order conveyed.
The Court further issued directive to the District Legal Services Authority, Ukhrul secretary to take necessary action as per law and also directed the Manipur Central Jail, Sajiwa superintendent to provide routine medical assistance to the convict as and when needed.
