Special Judge, Fast Track Special Court No 4 Manipur on Monday sentenced one Chingangbam Shamjai alias Shyamjai of Tharoijam Maning Leikai, who was convicted of raping and murdering an underaged girl in 2014, to 20 years of rigorous imprisonment.
During the sentence hearing on Monday, the defence counsel submitted that Shamjai was only 20 years old and a daily wage earner when he committed the crime.
Apart from a being a simple rural youth, his family as also in poor financial condition.
As such, he appealed to the Court to be lenient in awarding the punishment.
However, special PP argued that the accused not only sexually molested an 8-year-old girl but also killed the little girl, thereby leaving a great impact on the society.
Thus, he made an appeal to the Court to award the strictest of punishment to the accused so as to deter others from committing similar crime.
After listening to arguments of both sides, the Court sentenced Shamjai to 20 years of rigorous imprisonment under Section 6 of POCSO Act and life imprisonment under Section 302 of IRC.
Both sentences are to be served simultaneously and the time he stayed in the jail during the trial period will be commuted from the total sentence period.
After he has finished serving 20 years of rigorous imprisonment under Section 6 of POCSO Act, he must continue serving the life imprisonment sentence under Section 302 of IPC.
The Court further ordered Shamjai to pay a fine of Rs 3000, considering he has no source of income.
If he fails to pay the fine, he must serve one more month in jail.
