Bail application rejected

Special Judge POCSO Imphal West today rejected the bail application filed by mother of one rape accused on medical ground.
It is the 4th time bail application for Md Feji of Mayang Imphal Bangoon Mamang Leikai, who is accused of a rape and murder case of a minor girl on September 2 last year, was filed.
Mention may be made that the IO of the case had already submitted the charge sheet against six accused persons before the Court of Special Judge POCSO Imphal West on December 18 last year.
The bail plea was heard through video conference on August 12 before the order was passed today.
Petitioner counsel during the hearing submitted that accused Md Feji was arrested by a team of Mayang Imphal Police in connection with the case on September 4 last year on the allegation that one Muhammad was named in the FIR case.
It further submitted that no incriminating articles were recovered from the possession of the accused at the time of arrest and during the investigation no concrete prima facie evidence has been made against him.
Despite the charge sheet being received by the Court, the trial of the case could not be continued due to the COVID-19 pandemic.
Further it was also submitted that the accused is suffering from many ailments and in considering of his ailments, a previous bail application was filed but was rejected on April 28.In the application, the petitioner submitted that the accused has chronic heart diseases and newly developed serious abdomen ache and pain.
Following the application the Court directed SP Manipur Central Jail Sajiwa to submit a medical status report of the accused and the SP had forwarded a medical report submitted by Senior Medical Officer of Manipur Central Jail.
The Court perused the application as well as the medical document and on perusal of the medical record, it observed and found that the accused has been suffering from gastric problem but no other major ailment.
Accordingly the Court rejected the bail application.
It may be mentioned that the minor girl (victim) went missing on September 1 after she was reportedly called out by her accused boyfriend Md Arish on the pretext of eloping.
She was then found unconscious at a place at Mayang Imphal early morning the next day (September 2).She was rushed to RIMS where she received treatment in the ICU (Intensive Care Unit) Ward.
On the same day, police arrested her alleged boyfriend and prime accused Md Arish and two other co-accused Md Noor Mohammad and Md Mohammed @ Shahir.
The victim died of her injury at the RIMS ICU Ward the next day (September 3).Further during the course of investigation, Md Sikandar Ali and Majida Begum, parents of main accused/boyfriend Md Arish and co accused Md Feji were arrested by a police team and all of them were remanded to judicial custody on September 9 last year.
