Woman gets 6 months jail term

Session Judge, Imphal East today sentenced a 68-year-old woman to 6 months imprisonment in connection with the death of a 9 months pregnant woman in 2015 at Bidyanagar village in Jiribam.
The convict, Potsangbam Selendini was given the sentence after charges were framed against her under Section 304 of the Indian Penal Code for culpable homicide, not amounting to murder.
She pleaded guilty in the Court.
Potsangbam Selendini is wife of (L) Hem of Bidya-nagar village, Jiribam.
It may be noted that the case pertains to the death of a pregnant woman on January 9, 2015 at Bidyanagar village in Jiribam.
Selendini, the convict, was engaged in a fight with the daughter of the victim on January 9, 2015.When the victim, who was 9 months pregnant, tried to intervene, Selendini kicked her in the abdomen which knocked her down unconscious on the ground.
The pregnant woman was rushed to a Community Health Centre at Jiribam, but succumbed the same day.
The daughter then filed a police complaint and a case was registered against Selendini.
During the hearing today, the Court observed that Selendini had no intention to commit the crime and she herself tried to save the victim who was injured.
In addition, she had no criminal antecedent and also, she was an Anganwadi helper giving service to the children.
The Court also observed that the convict is a widow and a person living hand to mouth.
Considering all such aspects, the Court convicted Potsangbam Selendini under Section 304 IPC for culpable homicide not amounting to murder and sentenced her to 6 months in prison.
Further, as the convict was in custody from January 2015 to July 2015 during the period of the investigation, the Court ordered that the period of detention undergone by the convict be set off under Section 428 CrPC.
