Court reserves order on anticipatory bail pleas

The Court of Session Judge, Imphal West has reserved its order on the anticipatory bail applications filed by two guest lecturers and the assistant director of Saina Institute of Medical Sciences (SIMS), Porompat in connection with the alleged abduction and rape of a student by Yumnam Surjitkumar, managing director cum founder of the institute on August 14 till August 31 .
The three alleged co-accused namely; Sonia Yambem alias Nonibala Chanu (29) d/o Y Kulla of Bamon Kampu Yambem Leikai, Laishram Kunjarani Devi (28) d/o Laishram Ibopishak Singh of Top Khongnangkhong and assistant director of Saina Institute of Medical sciences (SIMS) Porompat SK Wajid Shah failed to appear before the Court even though they were directed by the same Court to appear in person during the hearing of the anticipatory bail applications.
SK Wajid Shah's counsel filed dispense application before the Court on medical ground and the application was allowed by the Court today.
During the hearing, the Court heard the APP of the State, Rakesh Meihoubam, the victim's counsel and defence counsels of the accused.
Counsels of Sonia Yambem alias Nonibala Chanu and Laishram Kunjarani Devi argued that it is not mandatory for the accused to appear before the Court during the anticipatory bail hearing.
Counsels of the accused maintained that their clients are falsely implicated in the present case and prayed for granting anticipatory bail to the co-accused.
On the other hand, the APP of the State and the victim's counsel alleged that the three co-accused conspired with the main accused Yumnam Surjitkumar (42) s/o Saratchandra Mangang of Khurai Kongkham Leikai in allegedly abducting and raping the victim.
The Court, after hearing submissions of both the parties in length and on perusal of the case record, reserved the order on anticipatory bail applications filed by the three co-accused till August 31 .
Nonetheless, the Court directed Nonibala Chanu, Laishram Kunjarani Devi and SK Wajid Shah to appear before the same Court on August 31 under Section 438 (1B) CrPC during the announcement of the reserved order.
The Court also extended interim pre-arrest bail of all three of them till August 31 .
Notably, an anticipatory bail application filed by Yumnam Surjitkumar, managing director cum founder of Saina Institute of Medical Science (SIMS) was disposed yesterday after his counsel did not press the application further before the Court yesterday.
