Chief Judicial Magistrate Imphal West has directed the SP of Imphal West to conduct an enquiry regarding a submission made by one Sanabam Gunajit before the Court today, alleging inhumane torture while in the custody of Special Cell, Imphal PS, and to take up necessary actions including registering of an FIR against involved police personnel if the allegation is true.
The order was passed today when Sanabam Gunajit Mangang (42) s/o S Dhabaljit of Uripok Kabrabam Leikai (presently staying at Khoyathong) was produced before the Court today.
It may be mentioned that Sanabam Gunajit Mangang and three others were paraded before media persons at SP Imphal West conference hall yesterday, in connection with their arrest as members of KCP (People War Group) and for their alleged involvement in the planting of an IED at Catholic School Canchipur on February 14.The said individual was produced along with a prayer for further 5 more days police remand under 20 UA (P) Act.
On the other hand, the defense counsel of the accused filed a remand objection and the Court registered a cril misc bail case.
After hearing the submission of both parties and going through the materials present, the Court expressed satisfaction with opting for further investigation of the case.
The Court also found that the accused was having injury marks on his buttock, and a minor fracture on his right hand and when enquired the accused stated that he was beaten and tortured while in custody of Special Cell Imphal PS.
Mentioning that torturing and subjecting an accused to such torture and punishment is an illegal act on the part of the police station concerned, the Court directed the SP Imphal West to conduct an enquiry into the allegation and to take up necessary actions if the allegation is true.
The Court further explained that the IO of the case is also responsible for the safe custody of the accused and the IO will be held legally and lawfully responsible for any form of torture or beating meted to the accused while in custody.
