CJM asks IO concerned to file written objection

Chief Judicial Magistrate, Imphal West has directed the IO concerned to file a written objection before March 4 for the hearing in connection with a cril miscellaneous case filed by one Adiki against Th Biswajit's first wife Junreiwon and two others.
The case was filed by Adiki (50) w/o (L) Sorokhaibam Achouba of Nagamapal Singjubung Leirak against the State of Manipur under section 156(3) of the CrPC, praying for monitoring the investigation taken up by Singjamei PS and for giving direction to the IO concerned to investigate the case as well as to issue warrant of arrest against Junreiwon, Apam and Trophy.
The prayer mentioned that the main accused of the case Junreiwon, Apam and Trophy are yet to be arrested and claimed that there is a possibility that they might abscond to avoid investigation.
Continuing that no efforts have been made to interrogate them by the investigating authority as well, the application further mentioned that Junreiwon has made herself unapproachable by the investigating authority by using the local clubs and Meira Paibis, which warrant strict intervention from the Court.
Other co-accused of the case are not identified till date and no efforts have been made to do so and the weapons used in the offence are still not seized or recovered by police, it alleged.
The application continued that the accused individuals are highly influential and there is possibility that they might intimidate the witnesses or the victim and as such there is need of additional/ inserting of a penal provision of section 325 IPC.
The same was invoked in the FIR inspite of the fact that the victim suffered disfigurement on her face apart from suffering from continuous bodily pain for 20 days.
The filed application then prayed for giving direction to the authority concerned to monitor the investigation of the FIR case, to direct the IO to investigate the offence of the registered FIR, to issue warrant of arrest for Junreiwon, Apam and Trophy, to direct the OC of Singjamei PS to insert section 325 IPC for just and proper investigation and to avoid lapses in the investigation and to call for periodical status report of the case.
After hearing the submission, the Court fixed March 4 for the submission of the written objection of filed miscellaneous case as well as its hearing.
