The Single Bench High Court of Manipur issued notice to Md Nasiruddin Khan returnable within three week in connection with the election recrimination petition filed by Keirao MLA Lourembam Rameshwor under Section 97 of the Representation of the People Act against the election petition number 8 of 2022 filed by Md Nasiruddin.
The election recrimination petition filed by Keirao MLA Lourembam Rameshwor was listed for hearing before the Court of Justice Ahanthem Bimol, High Court of Manipur.
The election petition filed claimed that the election of Md Nasiruddin Khan would have been void had he been elected in the general election of the 12th Manipur Legislative Assembly from Keirao Assembly Constituency for violating the provision under Section 33 and 33A of Representation of Peoples Act read with Rule 4A of the conduct of Election Rule 1961 .
The petition further mentioned that Md Nasiruddin Khan also violated 36 and 125 A of Representation of Peoples Act and provision of 19(1)(A) of Constitution of India.
His nomination was also accepted illegally by the Returning Officer in violation of Section 36(A) of Representation of Peoples Act, the petition read.
The Court after hearing the submission of the petition counsel issued notice to respondent Md Nasiruddin Khan returnable within three weeks and listed the matter for hearing on July 5 .
The same Court also granted time to counsel of Lourembam Rameshwor who prayed for three week time for filing a written statement in connection with the election petition filed by Md Nasiruddin Khan against the former.
