Imphal, May 04 2022:
Jyotin Waikhom, who contested the recent state assembly election on BJP ticket, has filed an election petition at the High Court of Manipur against sitting Thangmeiband AC MLA Khumukcham Joykisan, who won the polls on JD (U) ticket.
Jyotin filed the petition mentioning Joykisan and Congress candidate Hijam Nutanchandra as respondents.
According to the petition, many discrepancies were found in the affidavit submitted by (respondent no.l) Joykisan during nomination.
In the 11th Manipur Legislative Assembly election, Joykisan mentioned Jameson Khumukcham as a dependent.
But in the 12th Manipur Legislative Assembly, he mentioned only his wife RK Karuna, while withholding information that he has a son.
Joykisan married another woman named Kh (ongbi) Leonlee before separating from Karuna, resulting in the birth of his son Jameson Khumukcham, who is currently studying in Class VII at Kendra Vidyalaya.
Jameson's particulars mention Khumukcham Joykisan and Kh (ongbi) Leonlee as his parents.
In the recent election, Joykisan declared his income while citing that his first wife is a businesswoman and also, as a partner of M/S Khumukcham Constructions.
However, the respondent filled the column about the income tax return of his business partner as "nil" .
The respondent also did not file the income tax for 2017-18, Jyotin alleges in his petition.
The petitioner further mentioned that respondent number 1 took a loan of Rs 30 lakh but in his affidavit, he (Joykisan) stated that the total loan amount was Rs 27,16,780 .
The respondent then filed his affidavit on February 8 as a Janata Dal (United) candidate, but he drew salary as a Congress MLA till March 10 .
In 2017, he sold three properties but did not mention any details of the same in his affidavit.
In short, Joykisan withheld key information which is against the guidelines of Election Commission of India, the petitioner maintained.
The petitioner then appealed to the Court to hear the petition on daily basis and dispose the same as soon as possible, while further urging to disqualify the electoral triumph of respondent no 1 and declare the result null and void.
It further made a prayer for declaring the petitioner as the rightful winner of the 12th Manipur Legislative Assembly election from Thangmeiband AC.
After listening to the details of the petition, the Court directed that notices be sent to the parties concerned and fixed the next hearing on May 24 .
