Chief Engineer of the state PWD was penalized today by Gauhati High Court, Imphal Bench by imposing a fine of Rs 3,000 for failing to clear out a fund amounting to Rs 48,92,248 in respect of execution of a contract work in the department.
The ruling of the court was passed after hearing a petition filed the wife of a deceased contractor, H Sanot, Special Contractor, Ningchungla Horam, a resident of Kachai village of Ukhrul presently staying at Langol, Lamphel in Imphal.
In her petition to the court, Ningchungla alleged that despite several requests having made to the authority of the PWD to allow her to withdraw the pending amount, Rs 48,92,248, with the PWD for the contract works taken by her late husband, the payment has not yet been made.
The petitioner through her counsel, advocate M Devnand, was filed against the commissioner of works, secretary, finance commissioner, chief engineer of PWD and executive engineer of the PWD Ukhrul Division.
The writ petition was filed in the year 2007 .
The hearing of the case was held in the court of Chief Justice of the Gauhati High Court, Mandal B Lukur who is currently staying in the state capital.
The court had already gave a directive to the Chief Engineer of PWD, M Loken to take up necessary steps to clear out the pending amount for the execution of the work three year back on June 1, 2007 .
The petitioner submitted another writ petition to the court alleging that even after three has passed no response inspite of the clear direction of the court.
During the hearing held today the counsel of the respondent sought further time to file a counter affidavit.
But the court asked to pay a fine of Rs 3000 to the petitioner by the chief engineer as fine for failing to comply with court order.
