MPSC directed to allow MCS aspirants update data

Imphal, May 19 2022: The High Court of Manipur has asked the Manipur Public Service Commission (MPSC) to allow MCS aspirants to update their relevant data for the Manipur Civil Services Combined Competitive (MCSCC) (Main) Examination 2016 .

During the hearing of a petition filed by Naprem Brajeshwar and two others on Tuesday in the court of Justice Ahanthem Bimol, the petitioners submitted that they appeared in the MCSCC (Main) Examination, 2016 .

On February 11 this year, the Supreme Court of India directed MPSC to conduct the examination afresh within a period of four months and that only those candidates (successful/unsuccessful) who have appeared in the said examination (main) conducted in September, 2016 will be eligible to appear in the proposed examination.

Pursuant to the direction Of the apex court, MPSC took up necessary process for conducting the main examination afresh and in the process, MPSC issued a notification on March 24 informing the candidates eligible to appear in the examination to update the relevant data, which include recent passport size photograph, signature, mobile number, and postal address within the period of March 28 to the midnight of April 10 .

The petitioners submitted that through bonafide inadvertence, they were not aware of the notification through print media and the website of MPSC.

Accordingly, they failed to upload their data within the said period.

They then approached the MPSC authorities to allow them to update their data and to appear in the main examination as directed by the apex court by filing representations.

However, as MPSC failed to consider their representations, the petitioners approached the court with a prayer for directing MPSC to allow them to appear in the main examination.

When the matter was taken up, the senior counsel for MPSC submitted that it will be difficult on the part to allow the petitioners appear in the said examination as all preparations have already been made and since the petitioners failed to upload the relevant data within the given time period, they are not entitled to appear in the said main examination.

After hearing both sides, the court observed that the apex court has categorically directed MPSC to hold the main examination afresh and to allow all the candidates who appeared in the main examination conducted in 2016 to appear in the main examination to be conducted afresh.

Pursuant to the direction of the apex court, MPSC had also issued a notification dated on March 24 notifying the eligible candidates wherein the names of the petitioners are also included.

In view of these facts, the court observed that MPSC cannot sit over the judgments and directions given by the apex court and asked MPSC to allow the petitioners to update their relevant data within a period of two days from Tuesday and the commission should ensure that they are allowed to appear in the main examination to be held on May 26, 27 and 29 .

The court, however, made clear that the result in respect of the present petitioners in the said main examination shall be subject to the outcome of the writ petition, and listed the next hearing of the case on June 7 .

Consequently, MPSC has issued a notification on Wednesday informing that the window to online updation will be open for two days from 00:00 hours of May 19 till 24:00 hours of May 20 to allow the petitioners as well as other candidates, who could not update their details in time, to update the same through the link https://empsconline.gov.in/MCSCCE2016/verifyapplicant.aspx during the window period.

The notification, however, stated that their permission to appear in the examination is subject to the same terms and conditions as directed by the High Court.

e-Admit cards for these candidates can be downloaded till midnight of May 25 and examination venue for them will be notified shortly.

It also informed that applications from candidates, whose details are not updated within this window period of two days, as directed by High Court, will not be entertained.
