Imphal, March 06 2024:
Special Court NIA Manipur today rejected two different applications filed by Kwakta blast case accused Md Noor Hussain for securing bail and tendering pardon and becoming an approver of the case.
Accused Md Noor Hussain alias Tomba (37) hails from Kwakta Ward Number 8 .
He filed the applications on February 28 .
When Manipur was reeling under violence, an IED laden SUV vehicle had exploded on Kwakta bridge/culvert on June 21 injuring three persons including minors.
Initially, a case was registered with Phougakchao Ikhai police station before the NIA took over and re-registered the case.
In the case, the NIA has so far arrested three persons, Seiminlun Gangte of Phaikholum J Muntha village in Churachandpur, Md Noor Hussain and Md Islauddin, both of Kwakta Ward No 8 .
Seiminlun Gangte, arrested from Churachandpur, is presently lodged in Tihar Jail.
Md Noor Hussain is lodged at Manipur Central Jail Sajiwa.
Md Islauddin has been released on bail.
During the hearing of the case today, the counsel of the accused submitted that Md Noor Hussain was arrested in connection with the case on October 16 last year from Silchar, Assam and he has been in custody since then.
The counsel submitted that the accused is the sole bread earner of his family and he had gone to Assam to earn money.
The counsel submitted that Md Noor Hussain is ready to cooperate with the investigating authority and willing to disclose the whole facts of the case.
Praying for pardoning the accused and accepting him as an approver of the case, the counsel requested the Court to grant bail to Md Noor Hussain.
On the other hand, the Special Public Prosecutor of the NIA filed a written objection to the prayers and claimed Md Noor Hussain was directly involved in the IED blast.
The prosecutor alleged Md Noor Hussain was evading arrest by fleeing Kwakta before his arrest in Silchar.
The Special PP requested the Court to reject the applications and informed that the investigation is progressing and charge sheets will be submitted shortly.
The NIA Court, after studying the submissions, said it did not find reasonable grounds for pardoning the accused within the ambit of Section 306 CrPC and rejected the application filed for the same.
The Court further said it did not find reasonable ground for releasing Md Noor Hussain on bail.
The Court noted that the accused had helped other accomplices including ZRA militants by driving the bomb-laden Scorpio vehicle and parking it on Tiddim Road at Kwakta for executing the blast on June 21 .
Thereafter, he had also extracted a person sent by ZRA leadership from the site of the blast, said the Court, rejecting his bail application.
