Contending that the Right of Children to Free and Compulsory Education Act 2009 (RTE 2009) is not applicable to un-aided minority schools, the Catholic Educational Society, Manipur (CESM) has decided to conduct admission tests for St Joseph's School, Little Flower School, Nirmalabas School and Catholic School on January 28 as scheduled earlier.
A statement issued by the CESM director cited a Supreme Court judgement (Society of un-aided private schools of Rajasthan vs Union of India) of April 12, 2012 which reportedly stated "the Supreme Court of India upheld that the Right of Children to Free and Compulsory Education Act 2009 (RTE-2009) infringes the fundamental freedom guaranteed to unaided minority schools under Article 30 (1) of the Constitution of India.
"Hence the said law namely RTE-2009 shall not apply
to un-aided minority schools" .
