Justice M Binoykumar of Gauhati High Court, Imphal Bench has today maintained that the State Government should not evict structures belonging to 49 residents located along Khagempalli Road until the matter is finally disposed off.
The interim order was issued following a writ petition filed by one Th Suresh and 48 others who reside along the said road.
The petitioners challenged the Government notification issued on December 17, 2004 saying that eviction drive would be effected to acquire land for widening the road.
The petitioners, who are pattadars, are apprehensive that their lands might be acquired without following the provisions of the Land Acquisition Act.
While passing the interim verdict, the Court also issued notices to the Govt respondents making them returnable within 3 weeks.
Chief Secretary, Revenue Commissioner, Secretary and Director of MAHUD, DC Imphal West, CE PWD, Chief Town Planner and Director Settlement and Land Records are the listed respondents in the case.
Yesterday, the same Court restricted eviction of some buildings at Sega Road without due process of law.
