Murder accused granted bail

The Session Judge, Imphal East today granted bail to murder accused Konthoujam Ibomcha on execution of necessary PR bond and surety before the Court.
The bail order was announced today after it was kept reserve after the hearing of the bail application on July 17 .
The bail application was filed by accused Konthoujam Ibomcha (31) s/o (L) Bheigya of Angtha Mamang Leikai.
The case was on against the accused based on a complaint lodged by the husband of the victim on June 24, 2019 .
As per the complainant, his wife Kshetrimayum ongbi Sumati alias Ningol Devi went out of his house to meet a person at Wangkhei Thangpat Mapal at around 9.48 pm.
He, however, received a phone call from one Indira who informed him that his wife met with an accident at Thiyam Chingjin and on reaching the spot, he found his wife dead.
During investigation, it was assumed that one Sangeeta blackmailed accused K Ibomcha to take part in the murder of the victim, following which the accused impersonated as the maternal uncle of Sangeeta and husband of the victim.
On the day of the incident, the accused drove the twowheeler brought by the victim while his associates took the victim from one place to another looking for an opportune moment to 'kill' her.
The defence counsel submitted that not a single prosecution witness has been examined since the framing of the charge sheet and the accused is implicated in the case based on suspicion.
The defence counsel also submitted that the prosecution has failed to unearth any evidence to corroborate the charges levelled against the accused and added that no incriminating articles were also seized from his possession.
On the other hand, the APP submitted that there undoubtedly are enough prima facie materials showing involvement of the accused and claimed that examination of prosecution witnesses wasn't started earlier as conditions were not favourable due to the COVID-19 pandemic.
The Court, after hearing both the parties and on perusal of all the materials on record, issued an order to release Konthoujam Ibomcha on bail on furnishing a PR Bond of Rs 60,000 with a surety of similar amount and on the condition that he shall not abscond but present himself before the Court whenever required.
