Imphal, January 10 2024:
A division bench of the Supreme Court has rejected an appeal filed by Wangkhei MLA Thangjam Arunkumar against the judgement of the High Court of Manipur regarding an election petition filed by former Wangkhei MLA Okram Henry.
The former MLA had filed a petition in the Manipur High Court challenging victory of the incumbent MLA in the 12th Manipur Legislative Assembly election, stating that the latter failed to disclose certain information in the affidavits while filing his nomination papers.
In response, MLA Th Arunkumar filed a petition in the High Court, con tending that Henry's petition did not hold any merit and was un-maintainable.
During the hearing of the election petitions, the Manipur High Court noted that Henry's petition was maintainable and rejected Arunkumar's petition.
Arunkumar then went on to file a Special Leave Petition in the Supreme Court, challenging the High Court s judgement.
During the hearing of the Special Leave Petition on Tuesday, a division bench of Supreme Court comprising Justices Aniruddha Bose, Pamidighantam Sri Narsimha and Arabinda Kumar observed that there is no valid reason for interfering with the impugned judgement of the High Court of Manipur.
The High Court is fully capable of making the right decision.
As such, the division bench rejected the relevant applications filed in connection with the petition.
