Gangtok, October 24 2009: The negligence of Sikkim Manipal University and its admission criteria has came into scanner of High Court of Sikkim after three students of Second Year of MBBS has discharged from the medical institute at Tadong 5th Mile from their regular course of MBBS after one year of getting admission in the said medical institute saying that they had failed to secure 50 percent of marks in the Entrance Test of Sikkim Manipal University General Entrance Test (SMUGET) 2008 .

The divisional bench headed by Justice A P Subba and Justice Sonam Pintso Wangdi while passing interim relief order said that the impugned order issued by SMIMS shall not be effect to till next date of hearing which is listed for November 19 next month.

In September 23 last month, the Dean Dr.R N Salhan issued a letter to the three Second Year students informing them stating that since they had failed to secured 50 percent of marks in the Entrance Test of SMUGET, 2008 for MBBS admission, they shall stand discharge from SMIMS as students of MBBS with effect from October 22 .

Next day, the deprived students submitted a joint representation to the Dean with a request to recall and withdraw the impugned 'notice of discharge' and permitted the petitioner to continue with the course.

Despite of the passage of more than 15 days since the representation was made to the SMIMS Dean Dr.Salhan, the SMIMS authority neglected to take up any action on the representation of the students, as such the students has constrained to approached the judicial remedy challenging the validity of issuance of impugned notice of discharge from regular course and student of SMIMS with effect from October 22 .

It is learnt that three student admitted in 2008 after clearing all the procedure from SMUGET 2008 for medical course in SMIMS were admitted under reserved seats.

Tekhelnayum Sayon Singh from Imphal, Manipur was admitted under North-East reserved catagory, Rohit Tiwari was admitted under in-service reserved category, whose father is Chief Engineer of Sikkim Manipal Institute of Technology at Majitar, Rangpo and Monalisa a daughter of Defense personnel who is posted in Sikkim was admitted under Defense reserved category.

The deprived students claimed that on August 2, 2008 the admission Officer of SMU wrote a letter to the students in individual directing them to appear for counseling and admission and was also directed to deposited fee of Rs.3,95,850 for the academic year and passed the first year securing 61 percent, 64 percent and 59 percent respectively and has joined Second year, which academic session was begins from September last.
