68-yr old woman jailed in 2015 case

Imphal, February 19 2023:
Sessions Judge, Imphal East on Saturday sentenced a 68-year-old woman to 6 months in jail, in connection with the death of a woman in advanced stage of pregnancy on January 9, 2015 .
The convict Potsangbam Selendini (68) w/o (L) Hem of Bidyanagar village, Jiribam was produced before the court on Saturday, which sentenced her to imprisonment for 6 months under Section 304 of IPC.
During the sentence hearing, the additional PP appealed to the court to award the strictest of punishment to the convict while the defence counsel argued that the convict was not only an ailing 68-year-old woman but also lack stable source of income in Jiribam.
The counsel further appealed to the court to commute the time the convict had spent in jail during the trial period from the sentence.
After listening to both sides, the court observed that the convict did not intentionally commit the crime.
There was evidence that the convict tried to save the victim.
On top of this, the convict had no prior criminal record and had taken good care of many children as a helper in an Anganwadi centre.
As the convict is a widow and daily wager, the court sentenced her to 6 months of imprisonment under Section 304 (culpable homicide not amounting to murder) of IPC.
The court further said that as the convict had stayed in judicial custody from January, 2015 during the course of investigation of the case, the time she spent in judicial custody has been commuted from the total sentence period under Section 428 of CrPC.
As such, the convict is now released and her bail bond cancelled.
It also ordered for disposal of all seized items related to the case at the shortest time possible.
