Manipur Information Commission serves show cause notice

Manipur Information Commission has served show cause notice to SPIO, DC Thoubal asking why penal action u/s 20 (1) of the RTI Act, 2005 should not be initiated against him or her for not obliging with the direction of the Commission.
The notice was served during a hearing of an appeal case (No 103 of 2019) where Luwangchao Kabui is the appellant and SPIO/DC Thoubal are respondents.
During the hearing conducted via WhatsApp video today, the public authority represented by SDO of Lilong MD Ziaur Rahman, submitted a letter date October 7, 2020 addressed to the DC Thoubal stating that a case was put up in the Court of SDO, Lilong on September, 2020 for correction in the records of rights with due process of law.
The representative of the appellant, W Joykumar on the other hand, stated that the public authority has been taking too much time instead of giving the right information to the appellant.
The representative also pressed the Commission to initiate penal action u/s 20 (1) of the RTI Act, 2005 against the SPIO/DC Thoubal for failure to furnish the sought information as well as failure to furnish the enquiry report as directed by the Commission.
Upon hearing from both the parties, the Commission was of the view that the public authority has persistently failed to furnish the said enquiry report and thus the show cause notice was served to the SPIO/DC Thoubal asking why action should not be initiated for not obliging with the direction of the Commission.
The Commission also fixed November 27 for the next hearing and ordered the SPIO/DC Thoubal to furnish the reply to the show cause notice on or before the same date.
