HC to hear writ appeal over earlier court order on Feb 27

A Division bench of Gauhati High Court, Imphal today fixed February 27 as the date for final hearing of a writ appeal filed challenging an earlier court order over alleged discrepancies in the Manipur Civil Services Combined Competitive (Preliminary) Examination, 2010 conducted by Manipur Public Service Commission (MPSC).
After hearing the writ appeal challenging an earlier order passed on January 5 by a single bench of the High Court comprising Justice N Kotishwor, a sitting of the division bench comprising Justice Amitab Roy and Justice Anima Hazarika today fixed February 27 as the date for final hearing of the writ appeal and observed that the results of the MPSC conducted Combined Civil Service Main Examination, 2010 shall be subject to the outcome of this appeal.
Eleven candidates who appeared in the Manipur Civil Services Combined Competitive (Preliminary) Examination, 2010 have jointly filed the present writ appeal as appellant against Secretary of MPSC and Department of Personnel, Government of Manipur with Senior Advocate BP Sahu as counsel.
The writ appeal prayed for revoking the earlier order passed by the single bench of the court and conducting a fresh examination in the light alleged numerous discrepancies detected in the conduct of the examination by MPSC right from the stage of setting the questions.
The order of the single bench had directed the MPSC for constituting an expert committee to look into only four questions and allot necessary scores if any of the 11 petitioners have answered the questions correctly.
The order had further observed that 'upon re-determination of the correct answers in respect of the four questions, if any of the key answer is corrected/changed, MPSC would re-evaluate the answer scripts of the 11 writ petitioners only so as to ascertain if any of the petitioners had given correct answers to the four questions in the light of the review answer key and re-assess the marks of the petitioners' and 'if any of the petitioners, upon such reassessment, obtains marks within the cut off marks in their respective categories, he/they shall be deemed to have been qualified for appearing in the Manipur Civil Services Combined Competitive (Mains), Examination, 2010' .
The single bench also directed MPSC to publish the results of the reassessment exercise in respect of the 11 petitioners at the earliest, preferably within a period of three weeks and provisionally allow the petitioners to appear in the Mains examination.
