Ex-MLA advises Govt on CBI enquiry into Babysana case

Imphal, August 02 2019: Ex MLA of Keishamthong AC and former Law Secretary, Laisom Ibomcha, has asked the State Government to take consent under section 6 of the Delhi Police Establishment Act 1946, instead of sending a letter to the Home Ministry for CBI inquiry into the mysterious death case of Ningthoujam Babysana.

Speaking to media persons at his residence today evening, Laisom Ibomcha said it has been reported that the State Government has taken up steps to hand over the case to the CBI and in that regards, the Government sent a letter to the Home Ministry to the effect that CBI takes over the case.

He reasoned that an Act already exists which facilitates handing over of investigation to CBI directly by taking consent under the Delhi Police Establishment Act 1946, which is extended to Manipur and Tripura by virtue of the Merged States (Laws) Act 1949.Under the section 6 of the Delhi Police Establishment Act 1946, the State Government has the power to hand over the case to CBI directly and as such, there is no need for the State Government to send requests to any other authorities and the only thing required is to give consent and hand over the case to the investigating body without delay.

He also expressed that delay in handing of the case will delay the investigation.

Once the investigation is handed over to CBI, then there will be no jurisdiction of the State police in the investigation.

On the other hand, Laisom Ibomcha asked the State Government to make good on its claims and assurances of a corruption free recruitment process.

Written examination for recruitment to various posts under the State Government as well as Class X and Class XII exams should be carried out by supplying carbon coated answer sheets and should contain signatures of candidates in all the answer scripts and these copies should be taken home by the candidate after submitting the original copies to invigilators.

If this is implemented, then 99 percent of manipulation of answer scripts can be controlled, he claimed, adding that reports of manipulation and tampering of answer scripts of recruitment exams have been cropping up from time to time and the appeal is in the interest of the candidate and guardian to ensure that they can get jobs without spending any money.

Ibomcha also asked the Government and the authorities concerned to announce the marks secure by candidate of all recruitment exams against their names along with full addresses and to display the details in the respective Departments' websites.

The result of the viva voce or written exams must be announced under a time schedule and they should not be delayed, he added.

Laishom Ibomcha then appealed for a system to carry out complete evaluation of the question soon after the examination, if possible on the same day itself, which will prevent manipulation to some level.

If these practices are implemented, he opined that corruption will somehow be brought under control and the candidates applying for recruitment will not pay huge amounts of money by selling their land and properties.

He also demanded all the upcoming recruitment written examinations to be telecast live and urged the Government to make a statement proudly that recruitment has been done without any malpractices.
