CJM issues arrest warrant against MNDF candidate

Chief Judicial Magistrate Imphal East has issued an arrest warrant against Keisham Ningthemjao Singh, Manipur National Democratic Front (MNDF) candidate from Andro Assembly Constituency for failing to appear before the Court today despite a summon served on February 3 to do so.
A complaint was filed in the Court by one Salam Romen (41) s/o Udoi of Sagolband Bijoy Govinda against Keisham Ningthemjao Singh @ KN Singh (52) s/o (L) Kalubidhu of Yairipok Laimanai Top Chingkha under Negotiable Substances Act and 405 and 420 of Indian Penal Code.
The case was registered as cril complainant NI, Act case number 1 of 2017 .
In its order, the Court stated that the complainant and his counsel were present before the Court but the respondent (Ningthemjao) was absent despite a summon duly served on February 10 as per a report of OC Andro police station dated February 13 .
The Court issued a bailable arrest warrant against the alleged accused and fixed March 7 as the date for appearance of the respondent and further proceedings of the case.
In his petition filed on February 3, the complainant stated that in the mid of 2016 the alleged accused had requested him to give a loan of Rs 10 lakh as the former is in dire need of money.
The respondent had promised that he will repay the loan as and when demanded by the complainant.
After consideration of the request , the complainant gave the loan amount.
It mentioned that on December 14 of last year the alleged accused gave three cheques to the complainant.
The first one of Rs 1 lakh was issued by HDFC Thoubal Branch, the second one of 2 lakh by the same bank and the third one of Rs 7 lakh by UBI Thoubal Branch.
All the cheques were signed by the alleged accused in favour of the complainant for discharging the debt owned by the former.
Accordingly, the complainant presented and deposited the cheques to his saving account maintained with the Punjab National Bank Irilbung Branch.
To his utter surprise, all the three cheques given by the alleged accused were returned back to the complainant by UBI Thoubal Branch with a memorandum addressed to the Punjab National Bank Thoubal Branch with the remark "(I/F) Insufficient of fund and drawer's signature incomplete/differs" .
According to the petition, counsel of the complainant sent a legal demand notice to the respondent of the case under Section 138 of Negotiable Instrument Act, 1881 thereby requesting the latter to make payment of Rs 10 lakh to the complainant within 10 days from the date of receipt of the legal notice, failing which the complainant shall be constrained to file a criminal case against him under the Act.
Inspite of receiving the legal demand notice, the alleged accused has not paid the amount to the complainant, it alleged.
The alleged accused called up the complainant on January 11 and requested the latter to wait for 20 days as he is very busy in election campaign.
The alleged accused had assured that he will repay the loan amount without fail but failed to do so, the petition stated.
The complainant prayed before the Court to prosecute the alleged accused and punish him under Section 138 of NI Act, 1881 read with Section 405 and 420 IPC and to pass any appropriate court order deems fit and proper.
