Quashed MCSCCE 2016: Six file review petition

Imphal, February 29 2020: Six individuals have filed a review petition to the High Court of Manipur praying for the Court to review its order passed on October 18 last year which quashed the results of the MCSCCE 2016.The petition reminded that the High Court passed the order to quash the examination result based on the report of a fact finding committee, ruling that the MPSC did not have any intention to conduct any examination in a fair and just manner.

However, it claimed that two members of the fact finding committee are interested in cancelling the result of the MCSCCE 2016 as their sons and daughter were among the unsuccessful candidates.

Cancelling the examination results and conducting it afresh will be in their interest.

As such, the report submitted by the committee is biased, the petition argued.

The petition prayed for review of the judgement passed by the Court on the grounds that the two members of the fact finding com- mittee did not reveal the fact that their sons and daughter appeared in the examination and were unsuccessful.

Given this fact, the report of the so called independent fact finding committee should be quashed.

It argued that had this fact been submitted before the High Court during the earlier proceedings, the Court would not have passed the order to quash the results of the examination.

The petitioners narrated that they came to know about all these details only on December 20 last year when a copy of an RTI reply provided by the con- cerned SPIO, in the office of MPSC, (dated December 17, 2019), was shared to them by the person who filed the RTI on November 2 the same year requesting information about the list of candidates who appeared in the preliminary examination of MCSCCE 2016.They continued that they intimated the Chief Minister on December 23 about the discovery that one of the committee members, Yumnam Jugindro Singh, had a son and a daughter, namely Yumnam Alfred Singh and Yumnam Diana, who appeared the exam but could not get through.

It conveyed that on January 4 this year, the petitioners were able to procure copies of consumer data of MSPDCL which confirmed that the relationship between the trio.

The data also confirmed that the other committee member U Kol Singh alias Phuyam Kol Singh, was the father of another unsuccessful candidate, Phuyam Rameshchandra Singh In light of the new facts, the petitioners prayed to the High Court to review the judgement order of the Court which quashed the examination results, re-hear the earlier writ petitions and writ appeals on the basis of a report from a fresh independent enquiry committee and to pass an appropriate order regarding the same.

Satisfied with the argument, the High Court admitted the review petition and listed the matter for hearing on April 3 .
