Justice N Kotiswar today issued notice returnable within three weeks to the State respondents regarding the petition filed by Thounaojam Brinda, who has resigned as an Assistant Commandant of 9 IRB, against the former Commandant of 9 IRB, Mahila Battalion alleging fraudulent withdrawal of petrol quota.
The writ petition was filed by Th Brinda through her counsel on August 18 before the High Court of Manipur against the State of Manipur represented by Additional Chief Secretary Home, DGP Manipur Police, Commandant IRB Mahila Battalion and OC, Imphal police station.
The petition was listed before a single bench of Justice N Kotiswar Single as writ petition civil case number 606 of 2016 .
After hearing both the counsels today the single bench issued the notices returnable within three weeks.
The writ petition was filed under article 226 of the Constitution of India praying inter-alia for issuing writ in the nature of certiorari or mandamus or any other appropriate writ of the like nature for inquiring the fraudulent withdrawal of the petrol quota thereby causing misutilization and misappropriate in the name of the petitioner or to direct the authority concerned to refer the representation to the DGP Manipur police.
The writ petition mentioned that the petitioner was posted as the Dy Commandant of 9 IRB Mahila battalion from June 9, 2014 .
However no vehicle was allotted to the petitioner (Brinda) which was substantiated by the fact that the petitioner was enjoying travelling allowance as can been seen through the salary certificate issued from May to September 2015 and the petitioner has been commuting to the said unit/ office in her personal car.
However it came to the notice of the Brinda that petrol had been withdrawn in her name from May 15, 2015 to July 31, 2015 .
Thereafter a representation was submitted to the DGP apprising the matter.
The petition was submitted through the CO of 9 IRB.
As there was no development thereafter, the petitioner submitted a reminder to the DGP February 7 this year requesting the status of the complaint submitted by the petitioner earlier through Commandant of 9 IRB Mahila Battalion.
However no positive response was received from the DGP and authorities concerned and the representations/complaints were ignored.
The petition further mentioned that on March 15, 2016 the petitioner filed a report/information to the OC Imphal police station to register an FIR against the Commandant of 9 IRB Mahila Battalion for misappropriation of the petrol quota in the petitioner's name, said the petition filed in the Court.
