Following admission of Th Herojit...Sanjit's mother petitions HC

Late Sanjit's mother, Chungkham Taratombi approached the High Court ofManipur seeking full-fledged further investigation so as to arrest the then Additional Superintendent of Police, Imphal West, who ordered Herojit to kill an unarmed Chungkham Sanjit Meitei and also to punish the culprits in accordance with the procedure established by law.
Taratombi filed a Writ Petition before the High Court of Manipur on February 22 .
The Writ Petition was heard as item No 3 before the division bench comprising of Chief Justice Laxmi Kanta Mohapatra and Justice Nobin today around 11.30 am.
A team of lawyers led by Khaidem Mani, Senior Advocate and Meihoubam Rakesh, Director, Human Rights Law Network-Manipur Unit approached the Court seeking its direction to CBI for a fresh investigation based on the recent disclosure of Thounaojam Herojit, one of the prime accused who killed Chungkham Sanjit on July 23, 2009 .
Khaidem Mani drew the attention of the Court informing about misunderstanding created between the general public and Sessions Court which conducted the trial of this case.
Mani approached the bench to avoid the administrative duty of the Judge while hearing sensitive cases like Sanjit fake encounter case.
Ibohal, Advocate General of Manipur strongly objected the petition filed by the mother of Sanjit and he informed the bench that more than 70 prosecution witnesses have already been examined and therefore the present writ petition is not maintainable.
During the course of hearing, the relevance of Section 173 (8) of the CrPC which empowers the Investigation Officer to report regarding the new oral and documentary evidence were discussed.
It is to be mentioned that counsels who represented Central Government and CBI did not raise any objection to the writ petition filed by the mother of Chungkham Sanjit.
The bench asked the counsels of the petitioner to highlight relevant case law in this regard.
The case is likely to be heard on February 26 .
