MLA Rameshwor files election recrimination petition

BJP candidate Lourembam Rameshwor Meetei, who contested the 12th Manipur Legislative Assembly Election held in February this year and got elected as MLA of Keirao AC, has filed an election recrimination petition against NPP candidate Md Nasiruddin, in the High Court of Manipur.
The election recrimination petition hied by Rameshwor was heard in the court of Justice Ahanthem Bimol on Tuesday.
According to the petition, the affidavit submitted by Md Nasiruddin, who is respondent no 1, as part of Form-26, was filled with errors.
The affidavit mentioned that Nasiruddin had no pending criminal cases against him.
However, there is ongoing police investigation against respondent no.l in connection with FIR no 19 (2) 2017 u/sl47/149/427 of IPC and a case under section 25/27 of Arms Act.
He (Nasiruddin) also mentioned in para 7 of the affidavit of having a bank account at ICICI Lamphelpat Branch, which was afterward found to be long to Mayang Imphal NPP candidate Urikhimbam Ramesh.
He withheld the details of his personal bank account in the affidavit and instead used the details of the election account, mentioned the recrimination petition.
Respondent no 1 also wrote 'nil' in the column of para 7 of Form-26, which sought details on any mutual funds, investments in bond, debenture/shares and units.
However, he is currently listed as the owner of a company called Alienation Impacts and Construction Company Private Limited, as per information obtained from Ministry of Corporate Affairs.
The e-mail address used in the registration of the company was mentioned in his election affidavit, confirming that he is still the owner, although he failed to mention any details about the company in his affidavit.
The petition further said that respondent no.1 did not mention details of any non-agricultural land in his election affidavit.
He only mentioned one residential building as one of his unmovable assets, with an estimated market value of Rs 45,00,000.However, a G-Plus III residential building on the eastern side, a G-Plus II on the west and a G-Plus I residential buildings occupying 11761.2 sq ft of his total property area of 13830.3 sqft, were found present.
The respondent also stated in the affidavit that his spouse is a housewife but her income tax for 2021-22 was Rs 3,27,810.All of these indicate that respondent no 1 withheld many details and information in his affidavit.
As such, the petitioner urged the Court to permanently bar respondent no.l from contesting in future Manipur Legislative Assembly elections.
It also sought the election results of respondent no 1 in the 12th Manipur Legislative Assembly polls be declared null and void.
It then appealed to the Court to sustain the election result of the petitioner, who is the return candidate for 6-Keirao, while further making a prayer for respondent no 1 to be punished u/s 125 of Representation of The People s Act, 1951.After listening to the prayer, the Court issued a notice to the respondents mentioned in the petition.
