Four years RI for convict

Maibam Manojkumar, Session Judge Imphal West, sentenced a 47 year convict, Naorem Ingo, to four years rigorous imprisonment along with a Rs 50 thousand fine today.
Naorem Ingo (44) s/o (L) N Bhalop of Kakwa Makha Leikai Awang, who was convicted by the Court on March 12 was brought from the judicial custody of Manipur Central Jail Sajiwa for the sentence hearing of the case.
During the sentence hearing, the Additional Public Prosecution prayed for sentencing the convict to a maximum of 10 years imprisonment along with fine.
On the other hand, the defense counsel of the convict, contended that the death of the victim, N Sanatomba, was due to an unfortunate incident and the convict has been in judicial custody since his arrest on June 28, 2015 and there are no previous criminal records against the convict and prayed for sentencing the convict for the period which he has already undergone in judicial custody.
After considering all the mitigating factors, the Court sentenced the convict Naorem Ingo Singh to rigorous imprisonment for a period of four years along with a fine of Rs 50,000.The Court mentioned that in default of payment of fine, the accused convict has to undergo one more year simple imprisonment.
The Court further ordered the fine to be given to Naorem (o) Jano Devi of Kakwa Makha Naorem Leikai, the mother of the victim.
The Court further mentioned that the period which the convict has already undergone in judicial custody during the period of investigation as well as during the trial, if any, will be set off from the sentence.
Court recommended for providing victim compensation scheme under section 357 A of the code of the criminal procedure to the mother of the victim.
The sentence was announced in the open Court today.
