Don't disturb present post of Nursing Counsellor: HC to RIMS

High Court of Manipur has directed the competent authority of BUMS not to disturb the present post of Nursing Counsellor of RIMS held by Laimayum Kullabi Devi (52), wife of Kh Nobin Singh of Awang Sekmai Bazar until further order by the Court.
The judgment was passed in the Court of Justice N Kotiswar Singh, High Court of Manipur, very recently after the matter was heard by the Court following a petition filed by Laimayum Kullabi Devi, Nursing Counsellor of Physical and Medicine Rehabilitation RIMS, on September 18 .
The petition prayed the Court for directing the respondent (Director of RIMS) to extend the period of her deputation at RIMS as Rehabilitation Counsellor for another one year with effect from October, 6 this year.
The petition also mentioned that the Department of Personnel and Training, India, issued an office memorandum on September, 9, 2009 laying down guidelines for the posting of a husband and wife at the same station with the object and purpose of enhancement of women's status in all walks of life and to enable them to lead a normal family life and also to ensure the education and welfare of their children.
It also mentioned that strict instructions have been issued directing the authorities to follow the said guidelines in letter and spirit.
It further mentioned that, while the petitioner was working as Deputy Nursing Superintendent at Kawali Saran Children's Hospital, New Delhi, on regular basis, her husband Kh Nobin was appointed as the Judge of the High Court of Manipur and the petitioner submitted an application to the Secretary, Ministry' of Health & Family Welfare, India, requesting for appointing/transferring her on deputation as Deputy Nursing Superintendent at RIMS, under the terms of the policy for posting of husband and wife as mentioned.
After completing the formalities the petitioner was appointed to the post of Nursing Counsellor in the Department of Physical Medicine and Rehabilitation, RIMS on deputation basis for a period of 2 years on the terms and conditions as mentioned in the official letter.
As the expiry period of her deputation was October 6 and on account of her personal difficulties of living alone in Delhi and her desire to live together with her husband and children, the petitioner submitted an application on July 4 this year to the Director of RIMS, requesting him to extend the period of her deputation for another one year, but the Director failed to consider and take a decision due to the undue pressure exerted by the Nurse Association of RIMS.
As such the petitioner approached the High Court for directing the RIMS authority to extend the period of her deputation in RIMS as Rehabilitation Counsellor for another year.
In the meantime during the hearing of the said matter before Justice N Kotiswar Singh, the counsel of the respondent, Advocate Devananda, submitted that the request of the petitioner for extension of deputation period by another year is under process and RIMS authorities already wrote to the Ministry of Health & Family welfare, India on September 12 seeking advice regarding the matter.
After hearing both sides, the Court observed that as RIMS authorities have already written to the Ministry seeking advice on the issue, it would be appropriate to await necessary instruction/advice from the Ministry so that the RIMS authorities can take appropriate action which can be later examined by the Court.
As such the High Court directed RIMS authorities not to disturb the petitioner from her present place of posting until further order of the Court and listed the matter for consideration on October 26 .
