Imphal, September 18, 2009:
Challenging the ruling issued by a single Imphal Bench of Gauhati Court directing the State to take up an FIR case immediately in connection with the killing of Rabina on July 23, the state police have filed a writ appeal against the ruling in the Division Bench of the same Court.
Based on the report submitted by Rabina's husband, Chinglensana on August 24, the Court directed the OC of City Police to take up an FIR case immediately and also instructed the DGP and the SP Imphal West to see that the directive is put into action.
Referring to the writ petition heard by the single bench, police filed a writ petition in the same Court today challenging the earlier ruling.
Police also appealed to stay another order issued by the single bench on September 11 in relation to a miscellaneous case.
The Court received the appeal but no stay order was issued.
The Court also intimated that response to the appeal should be submitted within a week.
The respondent of the case in which police are the appellate is Thokchom ongbi Memi Devi.
The state of Manipur is the proforma respondent.
