The hearing of the petition filed by the State Government against an earlier ruling in the Th Manoroma's death case may come up for hearing by a Division bench tomorrow at Imphal.
The matter has been included in the cause list for tomorrow at the Gauhati High Court, Imphal bench and if time permits, it will be heard by a Division bench comprising of Justices MBK Singh and TNK Singh, sources said.
On the other hand Assam Rifles informed The Sangai Express that it has not received any intimation about the writ appeal filed by the State Government.
The State Government filed the appeal against a part of the ruling passed earlier by Justice D Biswas of the Principal seat on June 23 which is deemed to be unfavourable to the institution of the C Upendra Inquiry Commission set up by the State Government to probe the Manaroma case.
Though the earlier order explicitly maintained that the AR personnel should be punished if found guilty by the Inquiry Commission, it however asked the State Government to submit the findings of the Commission to the Union Home Ministry.
The petition filed by the State Government would urge the Court to allow the State to take up the punitive action against the guilty personnel without having to submit the report of the Commission to the Centre.
The State Government will also seek an order from the Division bench that the State Government has the legal authority to institute the Inquiry Commission under C Upendra and to take up action according to the findings of the probe report.
