Phaknung gang rape case : JJB rejects bail pleas

today rejected bail applications
of four Children in
Conflict with Law (CCLs)
who are amongst the accused
in the Phaknung gang rape
case.
The bail applications
were registered as JJ bail
case number 8 of 2017, 9
of 2017, 10 of 2017 and 11
of 2017 with reference to
FIR number 15 (4) 2017,
Women police station,
Imphal East under Section
376-D/120-B/363/34 of
IPC, Section 6 of POCSO
Act, 2012 and Section 3 (i),
(xi) and Section 2 (v) of ST
and SC (Prevention of
Atrocities) Act.
The bail applications
were taken up together for
consideration and disposal
before Principal Magistrate
JJB Imphal East,
Ningthoujam Lanleima;
Members Athokpam
Chinglemba and Yanglem
Dhaneshwari.
The four CCL were represented
by their counsels Y
Faruqe and KR Panmei
while the State was represented
by advocate Th
Bandana.
One of the counsels of
the petitioners submitted
that the four CCLs are entitled
to be released on bail
under Section 12 of JJ Act.
The counsel stated that
two of the four ( CCLs have given Class X examination while the remaining two
are studying in Class XII and in case they are not released on bail,
their study would suffer.
The Government counsel argued that the investigation of
the gang rape case is in the progress and the four CCLs are
required for conducting DNA profiling.
She submitted that in case the four CCLs are released on
bail at the present stage, it will hamper smooth investigation
of the case and will cause great prejudice to the case and the
rape victim.
Perusing the case record under Section 12 of
Juvenile Justice (Care and Protection of Children) Act, 2015,
the Justice Board dismissed and disposed the bail applications.
Meanwhile, Core Committee Against the Phaknung Gang
Rape stormed Observation Home, Takyelpat today demanding
ossification and scientific age proof test for the five juveniles
being kept at the home.
