Supreme Court issues Notice to ECI on Nagaland Bye-Election

Imphal, July 28 2017:
The Supreme Court today admitted the Special Leave Petition filed by NPCC with regard to the conduct of bye-election to 10 Northern Angami-I Assembly Constituency and issued Notice to the Election Commission of India that the result of bye-election shall be subject to the outcome of the matter.
It is pertinent to mention that the NPCC had filed a Special Leave Petition in Supreme Court against holding of bye-election, since it contravenes the provisions under Section 255 of the Representations of the Peoples Act, 1951 wherein it states:-
Notwithstanding anything contained in Section 147, Section 149, Section 150 and Section 151, a bye-election for filing any vacancy referred to in as of the said Sections shall be held within a period of six months from the date of occurrence of vacancy.
Provided that nothing contained in this Section shall apply if � .
(a) the remainder of the term of a member in relation to a vacancy is less than one year; or
(b) the Election Commission in consultation with the Central Government certifies that it is difficult to hold bye-election within the said period.
