Interim order on 'blocking NH-102' by Assam Rifles

Imphal, February 05 2015:
Hearing a Public Interest Litigation (PIL) filed at the Manipur High Court pleading relief from the hardships faced by the people from constant harassment due to action of the security personnel and restriction imposed by Assam Rifles (AR) from 6 pm to 6 am along National Highway (NH) � 102, Imphal-Moreh road, the Manipur High Court in an interim order said that it was unconstitutional to impose restriction on free movement of people who needed medical attention.
In an interim order, the Court has sought the reasons for imposing restriction by Assam Rifles and asked the "required investment to be incurred by the state" in mechanizing security measures and scrutiny along Imphal�Moreh road, said a source.
The Court has directed the Assam Rifles to completely remove the restriction to freedom of movement to patients who needed medical attention during the time of restriction imposed between 6 pm to 6 am.
The next hearing has been fixed for February 2 .
It may be mentioned that the PIL had contended that though Article 19 (1) (D) of the Indian Constitution guarantees the citizens the freedom of movement in any part of the country, the personnel of Assam Rifles in violation of the Constitutional rights have restricted movement along NH-102 (Imphal-Moreh route) from 6 pm to 6 am.
The PIL was filed by Thokchom Kumarjit from Thangmeiband with the Government of India, Government of Manipur, the commanding officers of 28th AR, 9th AR and 26 AR and secretary of home ministry as the respondents.
However, the discussion to move the PIL was deferred to February 5 as the Assistant Solicitor General who was to represent the Government of India could not be present.
