Imphal, July 18 2009:
Ex Deputy Speaker of the Manipur Legislative Assembly, Th Shyamkumar, at present detained in the judicial custody may now attend the ongoing Assembly session from July 20 onwards until the session is over.
Shyamkumar, mention may be made here, had resigned from the post of Deputy Speaker on April 16 last and surrendered before a local court here where he was sent to the judicial custody.
He is at present being treated at RIMS Hospital in connection with his heart illness after obtaining permission from the authorities concerned.
The state assembly had granted leave of absence to the MLA on the condition that the documents he submitted to the Assembly with regard to his application for granting him leave of absence will be verified.
Stating that his health condition has improved and could attend the session, his counsel Sh Ganashyam yesterday filed a petition to the Additional Session Judge, west-II, Tis Hazari Court, Delhi.
After hearing the petitioer's counsel yesterday, the court permitted him to attend the ongoing session of the Manipur Assembly under article 190 (4) of the Indian Constitution with a directive to the Imphal Central jail to take up necessary arrangements for the same.
Considering that Th Shyamkumar is a sitting member of the Assembly, he is permitted to attend the Manipur Legislative Assembly for the schedule to be taken place as per bulletin part-II of the Assembly from July 20 to 28 subject to observing all norms, rules and regulations, the order of the court given taking into account the article 190 (4) of Constitution.
The order asked superintendent of jail of Imphal to do the necessary arrangement/escorts etc.
so that Shyamkumar in custody, attend the Assembly and to lodge in jail.
It further reminded the jail superintendent that the present case FIR no 70/06 P.S Special Cell is schedule for July 31, 2009 .
