In a significant verdict the Principal Seat of Gauhati High Court today dismissed the review petition filed by the State Government on the previous verdict of the same court that had ordered for release of Irom Sharmila Chanu from custody.
A division bench of the principal seat headed by acting Chief Justice D Biswas passed the verdict, a reliable source said.
On September 21, the same court acting on a writ petition filed by lawyers of Human Rights Law Network, ordered the State to free Sharmila.
The court however maintained that the State authorities are at liberty to take care of her health and other nutritional requirements.
The petition contended that Sharmila is not attempting to commit suicide as alleged by the State by booking her under section 309 IPC but is staging democratic form of protest against the prolonged imposition of Armed Forces Special Powers Act from the State.
In consonance with the high court's verdict Sharmila was released from judicial custody on September 28.However she was again picked up and confined at JN Hospital.
