Chief Judicial Magistrate, Imphal today re-issued a show cause notice to the CO of 17 AR in connection with the application filed by the OC of Irilbung PS before the same Court requesting for allowing him to conduct DNA testing on the AR personnel involved in the arrest and subsequent killing of Thangjam Manorama Devi.
In his order, CJM Padmeshore Singh informed the CO to appear in person or to be represented by a pleader to show cause as to why the prayer of the petitioner (OC Irilbung PS) should not be allowed.
The Court fixed October 18 for further orders.
It also ordered that prosecution should take steps on the matter.
In an earlier instance, the same Court had issued the notice to the CO but no reply was made till date.
Additional Public Prosecutor appearing for the State was present today.
On August 31, the OC who is also the investigating officer of one of the two FIRs registered in connection with the killing of 32 year old woman filed the application before the CJM Imphal.
He requested the Court to issue an order allowing DNA testing on the AR personnel involved in the operation that resulted in the arrest and subsequent killing of Manorama.
The IO registered the FIR following a complaint filed by Thangjam Dolendra Meitei, younger brother of Manorama.
It is pertinent to mention that the application filed by the Army Court of Inquiry requesting the CJM to direct the State police to produce the DNA profile of semen stain found on the undergarment of Manora-ma before it had been rejected.
Meanwhile the office of CJM Imphal today returned the summon letter served on Th Basu, brother of Manorama to appear before the Army Court of Inquriy probing the circumstances that led to the death of the woman.The army court had issued summon through the CJM to five civilian witnesses including two family members of Manorama for their appearance before it, thereby the same were returned back to the same court.
