Jhalajit's interim relief to be heard today

Vijay Kumar Shukla, Additional SP CBI/SC II New Delhi along with Senior PP of CBI Atul Kumar arrived at Imphal in connection with further investigation into the July 23, 2009 case which has been stayed by an order issued by a single bench of the High Court of Manipur.
The Court fixed tomorrow for consideration of interim relief sought by petitioner Dr Ak Jhalajit.
Vijay Kumar Shukla and the Senior PP CBI are likely to appear before the High Court's Single Bench of Justice N Kotishwar Singh tomorrow.
IPS Dr Ak Jhalajit, CO 2nd IRB filed a criminal petition through his counsel DB Goswami under section 482 of CrPC before the single bench in the first week of March challenging the order of Session Court, Imphal West passed on February 14 in a criminal miscellaneous case number 25 of 2017 which gave liberty to applicant Vijay Kumar Shukla to proceed with further investigation in RC number 1 /2010- Imphal and RC 2 / 2010 �Imphal under section 173 of CrPC.
Dr Jhaljit's petition also sought other relief including issuance of direction to the respondent not to issue notice to him under section 160 Cr PC to appear before the CBI and stay of arrest till disposal of the petition.
The petition was registered and listed on March 6 before the single bench.
On the same day, the Court issued a notice returnable on April 3 for consideration of interim relief and CBI counsel K Pradeep accepted the notice on behalf of CBI.
The single bench also directed that the order passed by Session Court, Imphal West on February 14 shall remain suspended.
The investigation authority shall not subject the petitioner to any coercive action including arrest pursuant to the further investigation undertaken by CBI, mentioned the order issued by the High Court's single bench.
Notably, CBI had started further investigation into the BT Road killing of July 23, 2009 after getting permission from Session Court, Imphal West on February 14 .
CBI had already summoned and recorded statements of Dr Ak Jhalajit, CO 2nd IRB and nine other alleged accused against whom CBI had filed a charge sheet which included Y Munal, the than OC of City Police Station, Hijam Devendra, the then Inspector of police commando bazar unit, Thounaojam Herojit, Head Constable, Imphal West commando, Ngangom Toyaima, Riflemen 8th IRB, Wahengbam Bijoy, Constable Commando Imphal west, Thokchom Jagat, Havildar 8th Manipur Rifles, Md Imran Khan, Rifleman 5th IRB, Oinam Keshor, Head Constable Commando Imphal West and Makan Kanchung Chote, Constable Imphal West commando.
The CBI team also met Chungkham Sanjit's mother Chungkham Taratombi at her residence.
It may also be mentioned that CBI New Delhi decided to carry further investigation after a complaint was filed by Chungkham Taratombi before the CBI Director, New Delhi on December 28 last year after Head Constable Th Herojit made a confessional statement before media in January last year.
Herojit confessed that he had killed unarmed Chungkham Sanjit inside Maimu Pharmacy on July 23, 2009 as per the order of his superior officer Dr Ak Jhalajit, the then Additional SP Imphal West.
He also alleged that then DGP and Deputy Chief Minister Y Joykumar and O Ibobi, the then Chief Minister of Manipur had knowledge of the alleged fake encounter.
