Imphal, August 26 2019: Stating that the State Government has written to the Department of Personnel and Training (DoPT) to hand over the case of N Babysana to CBI, Chief Minister N Biren has appealed to the JAC Against the Mysterious Death of N Babysana Chanu to relax their agitation.

The Chief Minister further offered that he would instruct police to stop searching and arresting JAC members and other protesters.

Replying to a call attention motion raised by MLA Kh Joykisan in the State Assembly today, Biren noted that Babysana was a minor student and her mysterious death has shocked the whole State.

Taking serious note of the case, the State Government has been working at its best level to establish the facts and circumstances leading to the death of Babysana, claimed the Chief Minister who is also the leader of the House.

Even if the Government wishes to make certain statements regarding the controversial death, there is a confusion whether it would be sub-judice or pre-judice.

At the same time, the whole post mortem report cannot be divulged to the public.

The final word would be the decision arrived at by Court after the investigation agency submits a charge-sheet, Biren stated.

There might be certain errors or omissions as police disclose certain findings or clues regarding the mysterious death in their efforts to control mob action.

Post mortem examination with video coverage had been done twice.

The State Government sent to the Deputy Secretary, Home to DoPT along with all available documents to hand over the case to CBI, informed the Chief Minister adding that he would further pursue the matter.

Saying that the Government is committed to punish all the culprits according to law, Biren clarified that there is no question of the State Government ever trying to conceal anything in connection with the case of Babysana.

Raising the call attention motion, Kh Joykisan pointed out that it cannot be said the case has been handed over to the CBI if the document tabled by the Chief Minister in the House is the letter written by the Special Secretary, Home on July 29 to the Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training.

Asking why the Chief Minister cannot ask the Union Union Home Minister to hand over the case of Babysana to CBI, Joykisan appealed to the Chief Minister not to misinform the public.

Clarifying the points made by the Opposition Member, the Chief Minister stated that the uproar seen over the mysterious death of Babysana is largely a result of misunderstanding.

The earlier system of the State Government writing directly to the CBI to hand over a case is no longer in practice.

If any case should be handed over to CBI, it should be done through the DoPT and CBI would take over the case only after the DoPT has issued an order, Biren stated.

Joykisan then urged the Chief Minister to accept that the case has not yet been handed over to CBI even though due process is underway.

He further sought a concrete assurance from the Chief Minister that the case of Babysana would be definitely handed over to the CBI.

Saying that former Director Prosecution Ngangom Tejkumar was threatened with NSA for attending a meeting of the JAC, Joykisan urged the Government to stop threatening citizens.

If the State Government is not in a position to hand over the case to CBI, the JAC would go to Court, he said.

Opposition leader O Ibobi appealed to the Chief Minister to direct the DoPT to ensure that the case is taken over by the CBI.

Although the State Government has already written to the DoPT to hand over the case to CBI and there is nothing more to be done as per the official procedure, the Government would still pursue the matter at its best level, the Chief Minister replied while appealing to the JAC to relax their agitation.
