One remanded to 6 day police custody for inflammatory facebook comments

The Chief Judicial Magistrate Imphal West yesterday remanded one Waikhom Hemanta (56) for allegedly posting an unwanted comment on Facebook.
Accused Waikhom Hemanta of Mongsangei Mayai Leikai was arrested on 25 May at around 12.30 pm based on a written complaint lodged by Md Asker Ali Makakmayum of Lilong Haoreibi Sambrukhong before Singjamei police Station.
Waikhom Hemanta was produced before the Court through video conferencing along with the prayer for remanding to seven-day police custody.
The IO of the case through APP submitted that the accused on May 23, had posted many unwanted comments against the complainant "Cycle Huranba yaoba mi nangi kari toudoiba nangumba mathong maram Khandaba mi nate.
Namannba IAS tuna touridu yengu hui, sapon huranba dukandagi adugi wari faoba leihe nangi, Nangi history eina loina pairi Sanao Huranba" meaning "what will a person like you (complainant) who is involved in stealing cycle do, follow what your IAS friend is doing you dog, I have an account of you stealing soap from shops, I have all your history and records you cattle thief" .
With the comment the accused has blamed and charged the complainant in an unacceptable way which has not hurt the latter mentally, the IO submitted.
The comment also let down his dignity and community and may create anger, hatred among the communities of different religions, the IO said.
The IO of the case also submitted a check-list citing as to why his arrest was necessary.
The Court after perusing the check-list, materials placed before the Court observed that the accused has committed an offence punishable under IPC.
It was also observed that it was evident by the facebook post/comment that the said post hurt the religious sentiment of a religious group/ community which may seed communal disharmony.
The Court thus granted police custody remand of the accused till May 31 for further interrogation and to stop him from repeating the same offence which could cause any untoward incident between communities.
