High Court quashes Dr Sekharjit's plea

Demoted RIMS Director Dr s Sekharjit's plea to stay the order of his relieving him of the duties of RIMS Director and placing Dr Ch Arun Kumar in his place was quashed by a Single Bench of Manipur High Court headed by Justice N Kotishwar today.
Dr Sekharjit's petition said that as per the rule and regulation which are contained in the Memorandum of Association of RIMS, the term of office of the Director of RIMS must be five years or till the Director attains the age of 65 years and his service can be terminated by the Board of Governors in public interest at any time before the expiry of his term by giving him a notice of not less than three months in written or three months salary and allowance.
In response to the writ petition filed by Dr S Sekharjit, Assistant Solicitor General S Rupachandra submitted that there are serious allegations levelled against Dr S Sekharjit and a criminal case has been registered against him by the CBI for causing pecuniary loss to RIMS and other irregularities and also submitted that the competent authorities have taken up the steps by using the impugned order to relieve him from the post of RIMS Director in order to make necessary inquiry in this regard.
After hearing the arguments of the petitioner and the defence counsels, the Single Bench rejected the stay plea sought by Dr S Sekharjit.
The Court also sent a notice to the six respondents asking them to reply within four weeks time regarding the matter.
It may be mentioned that the writ petition was filed by Dr S Sekharjit Singh on August 26 last against the Union of India and five other respondents - Secretary of Health and Family Welfare, Government of India, President of Board of Governors RIMS, Chairmen of Executive Council, RIMS, Deputy Secretary of Ministry of Health and Family Welfare, Government of India and Professor and Head of Department Orthopedics, RIMS.
