Petition seeks stay on MSCW proceedings

A petition has been filed in the Manipur High Court requesting to stay the proceedings of a complaint made to the Manipur State Commission for Women (MSCW) .
The HC has fixed the hearing of the matter on November 24.According to a statement released to the press by Devalaya Committee general secretary Rajiv Dev, on September 27 around 5pm, six people engaged in a verbal and physical assault near his residence in Thangal Bazar under City PS .
At the time, he had a five-month old baby with him, based on which a complaint was filed at MSCW, which then took up the case.
After the incident, his family went to City PS but no action was taken up.
The Commission, after listening to the complaint, instructed the police to file a report on September 29 and October 9 .
However, the SP Imphal West, without filing the report, registered a case against six people including the president and secretary of Devalaya Committee.
The Commission then issued summons to the six people to come to the Commission on October 13.On October 13, the six people through their counsels submitted a miscellaneous application to the Commission requesting for dismissal of the complaint petition, along with another miscellaneous petition appealing to the Commission for disposing the summons.
However, the chairperson and member of MSCW did not approve the examination of the miscellaneous application.
The Commission also did not provide the copy of the order passed on October 13 nor allowed their counsels to get notes of the order.
It then ordered the petitioners to come to the Commission on October 19 .
Expressing dissatisfaction over the proceedings of the Commission, the six petitioners filed a miscellaneous petition in the High Court of Manipur requesting to examine the matter and direct MSCW to stay all proceedings until the two miscellaneous applications are heard.
After listening to the petition, the Court fixed the hearing of the matter on November 24 .
